Terms of service
Welcome to APRE Art House. By accessing www.aprearthouse.com, or by purchasing a work or booking a programme through this website, you agree to these Terms of Service. Please read them.
1. About Us
This website is operated by Ms. Prerana Sanjay Jain, sole proprietor, trading as APRE Art House ("APRE Art House", "we", "us"), a contemporary art gallery located at 2nd Floor, Arsiwala Mansion, Wodehouse Road, Colaba, Mumbai 400005, India.
GSTIN: 27ARZPJ4660R1ZL · IEC: ARZPJ4660R
2. Eligibility
You must be at least 18 years of age and legally capable of entering into a binding contract to purchase from this website. By placing an order you confirm that you meet these requirements and that the information you provide is accurate.
3. Artworks and Descriptions
Every work presented is an original by the artist named, unless expressly described otherwise. We describe medium, dimensions, year and condition as accurately as we can.
Photographs are indicative. Colour, tone, scale and surface quality vary between screens and cannot be relied upon as an exact representation. We are glad to provide additional images, detail shots or a video walkthrough of any work before purchase, and encourage you to ask.
Dimensions are given in centimetres or inches as indicated, and are approximate. Unless stated, dimensions exclude framing.
4. Availability and Reservation
All works are offered subject to prior sale. Because works are exhibited in the gallery as well as online, a piece may be sold before the website is updated. Where this occurs we will inform you promptly and refund any amount received in full.
A work may be placed on hold at the gallery’s discretion, usually for a period of 48 hours. A hold does not constitute a sale.
An order placed through this website constitutes an offer to purchase. A contract is formed only when we confirm the order in writing.
5. Prices, Taxes and Payment
Prices are listed in Indian Rupees (INR) unless stated otherwise. Goods and Services Tax (GST) is charged as applicable under Indian law and will be shown on your invoice.
Shipping, packaging, crating, insurance and framing are charged separately and quoted per work. Customs duties and import taxes on international orders are payable by the buyer — see our Shipping Policy.
Payment is accepted in full before dispatch. We accept bank transfer, and the online payment methods offered at checkout. Instalment arrangements may be considered for significant acquisitions and are agreed in writing on a case-by-case basis.
We reserve the right to correct pricing errors, including after an order is placed. Where a price has been listed in error, we will inform you and you may confirm the order at the corrected price or cancel it for a full refund.
6. Title and Risk
Title to an artwork passes to the buyer only on receipt of payment in full. Risk passes on delivery to the address provided.
7. Authenticity and Provenance
Works are supplied with documentation of authenticity from the gallery or the artist, as appropriate to the piece. Provenance details are shared where they are known and where the previous owner has consented to their disclosure.
8. Commissioned Works
Commissions are agreed separately in writing, setting out scope, medium, dimensions, timeline, price and payment schedule. Commissions typically require an advance, which is non-refundable once the artist has begun work. Creative interpretation remains the artist’s, within the parameters agreed at the outset.
9. Events, Talks and Programmes
Places at lectures, workshops, viewings and other programmes are limited and confirmed on payment. We may alter the date, format, speaker or venue where circumstances require, and will inform registered attendees as early as possible. Refund and transfer terms are set out in our Refund and Returns Policy.
Photography and video recording may take place at gallery events. By attending, you consent to your image being used in APRE Art House’s documentation and promotional material. If you would prefer not to appear, please tell a member of the gallery team on arrival.
10. Intellectual Property
Copyright in each artwork remains with the artist. Purchasing a work transfers ownership of the physical object only. It does not transfer copyright or any right of reproduction.
The buyer may not reproduce, publish, broadcast, or make commercial use of images of the work without the written consent of the artist. Private, non-commercial photography of a work you own is permitted.
All content on this website — text, curatorial writing, photographs, design, layout, the APRE Art House name and logo — is the property of APRE Art House or its licensors and is protected under Indian and international copyright law. It may not be copied, reproduced or used without our written permission.
11. Acceptable Use
You agree not to use this website for any unlawful purpose, to attempt unauthorised access to any part of it, to interfere with its operation, or to extract its content by automated means for commercial purposes.
12. Third-Party Links and Services
This website may link to external sites and relies on third-party services for payments, hosting, analytics and shipping. We are not responsible for the content, policies or practices of third parties.
13. Limitation of Liability
To the fullest extent permitted by law, APRE Art House shall not be liable for any indirect, incidental or consequential loss arising from the use of this website or the purchase of any work. Our total liability in respect of any order shall not exceed the amount paid by you for that order.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your rights under the Consumer Protection Act, 2019.
14. Indemnity
You agree to indemnify APRE Art House against any claim arising from your breach of these Terms or your misuse of this website.
15. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disaster, epidemic, civil disturbance, strike, government action, fire, flood or failure of transport or communications infrastructure.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of India. The courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising from them.
17. Changes to These Terms
We may amend these Terms from time to time. The version published on this website at the time of your order applies to that order.
